Tools for Navigating the New Transfer Rules

As you may know by now, House Bill 834 changed the rules of original jurisdiction, specifically for 16- and 17-year-olds charged with a Class A through E offense.  These youth will now be charged in adult criminal court, but can be removed to juvenile court upon motion of the defender and the prosecutor.  Additionally, any 13 through 15 year old who has been transferred to adult criminal court may now be remanded to juvenile court upon joint motion of the defender and the prosecutor.  To assist in determining where your client’s jurisdiction begins and other rules of transfer, please find two charts below.  We hope these help, but feel free to contact our office if you have any questions.
